What is the rental process before I pay, sign and collect keys?
A rental uses a tenancy agreement and agreed possession arrangements, not a purchase SPA or mortgage approval. Verify the landlord or authorised representative, inspect the unit and document rent, deposits, inclusions, repairs and termination terms. Do not assume every tenancy has the same deposit formula.
What to do next
Verify authority to let the particular unit and inspect it before agreeing reservation or payment terms.
Review the written tenancy: amounts, start date, permitted use, repairs, notice, deposit deductions and return conditions.
Use verified payment channels and receipts; sign an inventory and handover record with meters, keys and existing defects.
Deposits are not automatically fully refundable or forfeitable in every situation. Ask a solicitor to review disputed deductions, termination or possession issues; a template is not case-specific advice.
If a shop or factory rental is cancelled, will the booking payment be refunded?
A refund depends on the accepted offer, payment terms, conditions and the reason for cancellation; it is not automatically guaranteed. Before payment, set out what happens if licensing, an essential technical check, landlord acceptance or the formal agreement does not proceed. Ask a lawyer to review any conditional offer rather than relying on a verbal promise.
What to do next
Verify the property, landlord or authorised agent and the intended business use.
Agree each approval condition, deadline, cancellation consequence and refund mechanism in writing.
Pay only the agreed recipient, obtain a receipt and keep the accepted offer and correspondence.
Do not assume 'licence rejected' always means a full refund, or that an unsigned formal tenancy means the accepted offer has no effect. Disputes need the actual documents reviewed.
Who should arrange tenancy stamping, and what proof should I receive?
Clarify the responsible party and authorised handler for the actual tenancy instrument. Rental and lease instruments are in the first phase of HASiL’s STSDS from 1 January 2026. Confirm the submission and payment deadlines, the instrument details and applicable duty or relief; a document service fee is separate from government duty.
What to do next
Check the signed version, parties, rent, term, execution details and required tax identifiers; ask who is legally responsible and who will submit.
Use the current official HASiL channel or an authorised representative; verify the calculation and deadlines without sharing your account password.
Obtain the Stamp Certificate and relevant payment/application records, keep them with the matching signed tenancy and give each party its agreed copy.
Stamping is not approval of every tenancy clause or the premises’ use. Ask HASiL about the actual duty and filing treatment, and a solicitor about disputed clauses or evidential consequences.
How do I renew the tenancy or leave before the agreed end date?
Check the actual renewal, notice and early-termination clauses before making plans. A renewal rent or new term needs the required agreement; paying another month does not automatically settle every condition. If leaving early, seek written terms for the end date, outstanding payments, key return and deposit treatment.
What to do next
Find the relevant notice, renewal and termination clauses and calculate dates from the actual agreement, not a market-standard assumption.
Send the required written notice through the agreed method; request written agreement for renewal changes or an early-exit settlement.
Confirm the final inspection, bills, keys and deposit accounting; take the documents to a Malaysian lawyer if the parties disagree.
There is no universal right here to end any tenancy by giving a fixed notice or forfeiting the deposit. Do not stop rent or treat the deposit as final rent without a lawful, documented basis.
